Terms of Service

1. Agreement

These Terms of Service ("Terms") constitute a binding legal agreement between you and [YOUR_LEGAL_ENTITY] ("Vitalio"). By creating an account or using the app, you agree to these Terms. If you do not agree, do not use the service.

2. Eligibility

You may use Vitalio if you are at least 16 years old, OR between 13-16 with parental consent (where local law allows). You may NOT use it under 13. By using, you confirm all info you provide is accurate.

3. Account

One account per person. Authentication via email magic link. You are responsible for keeping your email secure. We may suspend or delete accounts we believe are fraudulent or abusive.

4. Acceptable use

You agree NOT to: use the service illegally, reverse engineer or decompile, use automated tools / bots, submit hateful or sexually explicit content (especially involving minors), submit copyrighted material you don't own, resell or rebrand the service, bypass rate limits or paywall. Violations may result in immediate termination without refund.

5. Subscription terms

Free tier: 3 AI chats/day, 3 photo scans/day, 5 recipe imports/day, full workouts & meal plans. Premium: $9.99/month or $59.99/year. 7-day free trial for new users. Includes unlimited AI features, advanced personalization, recovery & cycle integration, Future Self predictions. Auto-renewal: subscription auto-renews unless you cancel at least 24h before the end of the period. Cancellation: • iOS: Settings → [Your Name] → Subscriptions → Vitalio • Android: Play Store → Subscriptions → Vitalio Refunds are governed by Apple App Store / Google Play, NOT by us. For Apple: reportaproblem.apple.com. For Google: play.google.com → Order history. Price changes: existing subscribers notified at least 30 days before new price applies. You can cancel to avoid it.

6. AI features — important disclaimers

Vitalio uses Anthropic Claude AI for food scanning, recipe import, and the personal coach. AI estimations are NOT medical or nutritional advice. Calorie/macro estimates from photos have ±20-30% error margin. AI coach uses general fitness knowledge, not your medical history. Do NOT rely on AI for: medical diagnosis or treatment, managing chronic conditions (diabetes, eating disorders), pregnancy/postpartum, injury recovery. Always consult a qualified professional.

7. Health & fitness disclaimer

Exercise and dietary changes carry inherent risks. By using Vitalio, you acknowledge that: • You will consult a physician before starting any new exercise or diet program • You will stop immediately if you experience pain, dizziness, or shortness of breath • We are NOT liable for any injury or health issue resulting from following app advice • Meal plans assume no severe allergies. You are responsible for verifying ingredients.

8. Intellectual property

Our content (app, brand, code, system recipes, AI coach personality) is owned by us. You receive a limited, non-exclusive license while your account is active. Your content (photos, imported recipes, workout logs) remains YOURS. You grant us a limited license to process it solely to provide the service. AI-generated outputs are yours to use, but we make no guarantees about exclusivity.

9. Termination

You can delete your account anytime: Settings → Account → Delete account. Irreversible. We may suspend or terminate for: Terms violation, fraudulent activity, legal/court order, service discontinuation (with 30-day notice). If we terminate without cause, we refund unused prepaid premium time pro rata.

10. Limitation of liability

Service provided "as is" without warranties. We are not liable for indirect, incidental, or consequential damages. Total liability is limited to amounts you paid us in the 12 months preceding the claim. This limitation does NOT apply to: damages from our intentional misconduct or gross negligence, personal injury caused by us, or any liability that cannot be limited under EU consumer law.

11. Governing law & jurisdiction

Romanian law and EU regulations apply. We encourage contacting hello@vitaliopro.com first. For unresolved disputes, EU consumers can use ODR platform: https://ec.europa.eu/consumers/odr. Romanian courts have jurisdiction, except where EU consumer law grants the right to sue in your home country.

12. Changes to these Terms

Material changes notified via in-app notification at least 30 days before effective date. Active subscribers also notified by email. Continued use after the effective date constitutes acceptance. You can cancel before the new Terms take effect, with refund of unused premium time.
